Please have this reviewed. This document was prepared as a thorough, well-organized starting point tailored to a Colorado yoga, somatic, and coaching practice. It is not legal advice and no attorney–client relationship is created by it. Before publishing, have a Colorado attorney review it against your actual services, insurance requirements, studio or landlord agreements, and any third-party tools you use.

These Terms of Service govern your use of the Art of Liminality website and your participation in any yoga, somatic wellness, coaching, workshop, or group service offered by Art of Liminality. Please read them carefully. They include an assumption of risk, a release of liability, and a limitation of liability that affect your legal rights.

1. Agreement to These Terms

By visiting this website, submitting an inquiry, booking a session, or participating in any service offered by Art of Liminality (“we,” “us,” “our,” or the “Practice”), you (“you,” the “Client,” or the “Participant”) agree to be bound by these Terms of Service and by our Privacy Policy, which is incorporated here by reference. If you do not agree, please do not use this website or participate in our services.

Some services may also require you to sign a separate participation agreement, informed consent, or liability waiver. Where a signed document conflicts with these Terms, the signed document controls for that service.

2. About Art of Liminality

Art of Liminality is a wellness practice owned and operated by Aleecia Mata, RYT-200, a Registered Yoga Teacher, offering trauma-informed yoga, somatic wellness education, and integrative coaching. The Practice is located at 525 N. Cascade Avenue, Colorado Springs, CO 80903, and also offers services online.

Art of Liminality is not a licensed medical practice, psychotherapy practice, counseling agency, or healthcare facility, and is not licensed by the Colorado Department of Regulatory Agencies to provide psychotherapy or medical services.

3. Nature of Services and Scope of Practice

Our services consist of movement instruction, breath and somatic awareness education, general wellness education, and non-clinical coaching conversations. They are designed to support self-regulation, embodied awareness, and personal growth.

Within our scope of practice, we may:

Teach yoga postures, breath practices, and mindfulness or grounding techniques;
Offer general, non-clinical education about the nervous system and stress responses;
Facilitate reflective coaching conversations about values, goals, and life transitions;
Provide invitational, choice-based movement adapted to your stated needs.

Outside our scope of practice, we do not:

Diagnose, treat, cure, or prevent any physical, psychological, or emotional condition;
Provide psychotherapy, counseling, trauma processing, or mental health treatment;
Provide medical, chiropractic, physical therapy, nutritional, or nursing services;
Prescribe, adjust, or advise on medication, supplements, or medical treatment;
Provide crisis intervention, emergency services, or after-hours clinical support;
Provide legal, financial, or tax advice.

If your needs fall outside this scope, we will tell you plainly and, where possible, offer referral information for licensed providers.

4. Not Medical or Mental Health Care

Nothing on this website or in any session is medical or mental health advice. Content and services are provided for general educational and wellness purposes only. They are not a substitute for diagnosis, treatment, or advice from a licensed physician, psychologist, licensed therapist, or other qualified healthcare professional. Never disregard professional medical advice or delay seeking it because of something you read here or discussed in a session.

In an emergency, do not use this website or contact form. Call 911, go to your nearest emergency department, or call or text 988 to reach the Suicide & Crisis Lifeline. Inquiries submitted through this website are not monitored continuously and must not be used to communicate urgent or emergency needs.

5. Eligibility and Minors

Services and this website are intended for individuals eighteen (18) years of age or older. By using the site or booking a session, you represent that you are at least 18 and have the legal capacity to enter into these Terms.

Participants under 18 may be accepted only by prior arrangement and only with the written consent and, where we require it, the on-site presence of a parent or legal guardian. A parent or guardian who enrolls a minor agrees to these Terms on the minor's behalf and on their own behalf.

6. Your Health Disclosure and Responsibilities

You agree that you are responsible for your own physical and emotional wellbeing during any session. Specifically, you agree to:

Consult a physician before beginning any new movement practice, particularly if you are pregnant or postpartum, recovering from injury or surgery, or living with cardiovascular, respiratory, neurological, musculoskeletal, or other health conditions;
Disclose any injury, condition, limitation, medication, or circumstance that could reasonably affect your safe participation, and to update us if it changes;
Practice within your own limits, modify or rest at any time, and stop immediately if you feel pain, dizziness, faintness, or distress;
Decline any invitation that does not feel right for you, without needing to explain;
Inform us promptly of any discomfort, injury, or adverse experience during or after a session.

We rely on the accuracy and completeness of what you disclose. We cannot adapt a practice to a condition we do not know about.

7. Assumption of Risk

You understand that yoga, somatic movement, breathwork, and related practices are physical activities that carry inherent risks, including but not limited to: muscle strain, sprain, or tear; joint, back, or neck injury; falls; dizziness, lightheadedness, or fainting; aggravation of a pre-existing condition; and, in rare cases, serious injury.

You further understand that practices involving breath, stillness, interoceptive attention, or reflection may bring up strong emotions, unexpected memories, physical sensations, or temporary distress, and that this is a recognized possibility in body-based work.

Knowing these risks, you voluntarily choose to participate and expressly assume all risk of injury, loss, or harm, whether foreseen or unforeseen, arising from your participation.

8. Release and Waiver of Liability

To the fullest extent permitted by Colorado law, you release, waive, discharge, and covenant not to sue Art of Liminality, Aleecia Mata, and their respective owners, employees, contractors, volunteers, agents, landlords, and facility providers (collectively, the “Released Parties”) from any and all claims, demands, damages, causes of action, or liabilities of any kind arising out of or related to your participation in any service, your use of any facility or equipment, or your use of this website, including claims based on the ordinary negligence of the Released Parties.

This release does not apply to, and nothing in these Terms limits liability for, willful and wanton conduct, gross negligence, intentional misconduct, or any liability that cannot be released or limited under Colorado law.

9. Booking, Payment, and Fees

Sessions are scheduled by mutual agreement following an initial conversation. A session is confirmed only when we confirm it in writing.
Current rates are provided at the time of inquiry or booking and may change with notice. Rates already agreed for a scheduled session or a purchased package will be honored.
Unless otherwise agreed in writing, payment is due at or before the time of service.
Packages, series, and workshop fees are due in full in advance unless a payment arrangement is agreed in writing.
Packages and class passes expire as stated at purchase and are non-transferable unless we agree otherwise in writing.
Services are private pay. We are not a licensed medical or mental health provider, we do not bill insurance, and we make no representation that any fee is eligible for insurance reimbursement or for payment from an HSA or FSA. Please confirm eligibility with your own plan administrator.
Returned payments or failed charges may incur a reasonable processing fee, and outstanding balances may result in suspension of scheduling until resolved.

10. Cancellation, Rescheduling, and No-Shows

24-hour policy. Please provide at least twenty-four (24) hours notice to cancel or reschedule a private session. Sessions cancelled with less notice, and sessions missed without notice, may be charged in full.
Late arrival. Sessions end at the scheduled time so that the day's rhythm is protected for everyone. Late arrival shortens the session and does not reduce the fee.
Workshops, series, and groups. Because a seat is held for you and group size is intentionally limited, cancellations within seven (7) days of the start date are generally non-refundable, though a credit may be offered at our discretion.
Cancellation by us. If we must cancel a session for illness, emergency, or weather, you will be offered a reschedule or a full refund of that session's fee.
Grace. Genuine emergencies, sudden illness, and unavoidable circumstances are considered individually and in good faith. Please simply tell us.

11. Conduct, Consent, and the Right to Decline

This practice depends on a safe, respectful environment for everyone in it. You agree to treat other participants and the instructor with respect, to refrain from harassing, discriminatory, threatening, or disruptive behavior, and not to attend while impaired by alcohol or non-prescribed substances.

Consent to touch. Hands-on assistance is never provided unless you specifically request it and consent to it in advance. Consent is specific, revocable at any time, and may be withdrawn without explanation. Declining touch will never affect the quality of your care.

Your right to stop. You may modify, rest, pause, leave the room, or end a session at any time. Sessions ended early at your request are charged as scheduled unless we agree otherwise.

Recording. Please do not photograph, film, or record any session, group, or workshop without prior written permission from us and from every participant present.

12. Confidentiality and Its Limits

We treat what you share with discretion and respect, and we do not sell, rent, or trade client information. However, because Art of Liminality is not a licensed healthcare provider, our services are not covered by HIPAA, and what you share is not protected by psychotherapist–client privilege or any comparable legal privilege.

We may disclose information without your consent where we reasonably believe disclosure is required by law or necessary to prevent serious harm, including: a credible risk of serious harm to you or to an identifiable other person; suspected abuse or neglect of a child, an at-risk elder, or an at-risk adult, as required by Colorado reporting law; a valid subpoena, court order, or other lawful demand; or a medical emergency occurring during a session.

With your written consent, we are glad to coordinate with your therapist, physician, or care team.

13. Communications and Electronic Consent

By providing your email address or phone number, you consent to receive communications from us electronically regarding scheduling, your inquiry, and your services. You may opt out of marketing or newsletter emails at any time using the unsubscribe link; transactional messages about a scheduled session are not marketing and will continue while you are an active client.

Email, text message, web forms, and voicemail are not secure or confidential channels. Please do not send detailed health information, and never use these channels for urgent or emergency needs. You agree that electronic agreements, notices, and signatures satisfy any requirement that such communications be in writing.

14. Acceptable Use of This Website

You agree not to use this website to violate any law; to attempt to gain unauthorized access to any system or data; to introduce malware or other harmful code; to scrape, harvest, or bulk-collect content or contact information; to submit false, misleading, or third-party personal information without authorization; to interfere with the site's operation; or to reproduce site content for commercial purposes without permission.

We may suspend or block access to the site for any conduct we reasonably believe violates these Terms.

15. Intellectual Property

All content on this website — including text, copy, photography, illustrations, the “Art of Liminality” name, the dragonfly monogram, logos, brand colors and typography treatments, session materials, handouts, sequences, and recordings — is owned by Art of Liminality or its licensors and is protected by copyright, trademark, and other intellectual property laws.

You may view, download, and print site content for your own personal, non-commercial use. You may not reproduce, republish, distribute, adapt, teach from, or create derivative works from our content or materials without our prior written permission. Materials provided to you as a client are licensed for your personal use only and may not be shared, resold, or used to instruct others.

16. Testimonials and Results

Any testimonials, reviews, or client experiences shared on this website reflect the individual experiences of specific people and are not a guarantee, warranty, or prediction of any particular outcome. Results vary based on many factors, and we make no promise regarding the results you may experience. Testimonials are published only with the individual's permission and may be edited for length or to protect privacy.

17. Third-Party Links and Services

This website may link to or rely on third-party websites and services, including form handling, scheduling, payment processing, email delivery, and hosting. We do not control third-party sites or services and are not responsible for their content, availability, security, or privacy practices. Your use of a third-party service is governed by that provider's own terms and privacy policy.

18. Accessibility

We want this website and this practice to be usable by everyone. We aim to meet the Web Content Accessibility Guidelines (WCAG) 2.1 Level AA and we work to accommodate physical, sensory, and cognitive access needs in sessions wherever we reasonably can. If you encounter a barrier on this site, or need an accommodation to participate, please contact us at hello@artofliminality.com or 719.751.6684 and we will work with you to find an alternative.

19. Refusal and Termination of Services

We reserve the right to decline, postpone, or discontinue services at any time, including where we believe the service is not appropriate for your needs, where a licensed provider would serve you better, where conduct or safety concerns arise, where scope-of-practice boundaries cannot be maintained, or where fees remain unpaid. Where services are discontinued by us for reasons other than conduct, unused prepaid fees will be refunded on a pro-rata basis.

20. Indemnification

You agree to indemnify, defend, and hold harmless the Released Parties from and against any claims, liabilities, damages, losses, and expenses, including reasonable attorneys' fees, arising out of or related to your breach of these Terms, your violation of any law or the rights of a third party, or your participation in any service, except to the extent caused by our gross negligence or willful misconduct.

21. Disclaimer of Warranties

This website and all services are provided on an “as is” and “as available” basis. To the fullest extent permitted by law, we disclaim all warranties, express or implied, including implied warranties of merchantability, fitness for a particular purpose, and non-infringement. We do not warrant that the site will be uninterrupted, secure, or error-free, or that any information on it is complete, current, or accurate.

22. Limitation of Liability

To the fullest extent permitted by Colorado law, the Released Parties will not be liable for any indirect, incidental, special, consequential, exemplary, or punitive damages, or for lost profits, lost data, or loss of goodwill, arising out of or related to this website or any service, regardless of the theory of liability and even if advised of the possibility of such damages.

To the fullest extent permitted by law, our total aggregate liability for any claim arising out of or related to these Terms, this website, or any service will not exceed the greater of the total amount you paid to Art of Liminality in the six (6) months preceding the event giving rise to the claim, or one hundred dollars ($100).

Some jurisdictions do not allow certain limitations, so some of the above may not apply to you. Nothing in this section limits liability for willful and wanton conduct, gross negligence, or any liability that cannot lawfully be limited.

23. Governing Law and Dispute Resolution

These Terms are governed by the laws of the State of Colorado, without regard to conflict-of-laws principles.

Informal resolution first. If a dispute arises, you agree to contact us first and to attempt in good faith to resolve it informally for at least thirty (30) days before initiating formal proceedings. Most concerns are resolved this way.

Mediation. If informal resolution fails, the parties agree to attempt mediation in El Paso County, Colorado, with a mutually acceptable mediator, sharing the mediator's fees equally, before filing suit.

Venue. Any action not resolved through mediation shall be brought exclusively in the state or federal courts located in El Paso County, Colorado, and you consent to the personal jurisdiction of those courts. Nothing here prevents either party from seeking relief in small claims court or seeking injunctive relief to protect intellectual property.

24. General Provisions

Severability. If any provision is held unenforceable, it will be modified to the minimum extent necessary or severed, and the remaining provisions will remain in full force.

No waiver. Our failure to enforce any provision is not a waiver of our right to do so later.

Assignment. You may not assign these Terms. We may assign them in connection with a sale or transfer of the practice.

Force majeure. We are not liable for failure or delay caused by events beyond our reasonable control, including illness, severe weather, utility or internet failure, facility closure, or public health orders.

Entire agreement. These Terms, the Privacy Policy, and any signed participation agreement or waiver constitute the entire agreement between you and Art of Liminality regarding this subject matter.

25. Changes to These Terms

We may update these Terms from time to time. The “Last updated” date at the top of this page reflects the most recent revision. Material changes will be posted here, and your continued use of the site or services after changes take effect constitutes acceptance. Please review this page periodically.
